Here are the terms and conditions you agree to as a member of the Windham Sailing Club.
As a Mooring Member or a Junior Mooring Member I agree to the following:
1. Great River Hydro, LLC, the owner of the lake, permits the mooring of sailboats at Ward’s Cove meeting these requirements: 20’-0” maximum overall length, no inboard motor, and no head with through-hull fittings. The Windham Sailing Club, Inc. (WSC) administers the mooring process. WSC provides no other services.
2. My mooring fee is used in part to pay for the cost of liability insurance to protect WSC and Great River Hydro, LLC from certain claims resulting from WSC activities. The insurance policy excludes claims made by club members against WSC and Great River Hydro, LLC.
3. WSC and Great River Hydro, LLC are not responsible for claims arising from the operation of my boat, be it operated by me or by others.
4. WSC and Great River Hydro, LLC are not responsible for the security of my boat including its gear and other personal property.
5. It is my responsibility to provide appropriate ground tackle conforming to WSC standards and to keep my boat properly moored. Great River Hydro, LLC and WSC are not responsible for any damage suffered by my boat while it is moored or if it should break free from its mooring. I understand that even the best tackle and mooring equipment may break and not withstand severe weather and wind and hereby accept responsibility should my equipment fail. I understand that my mooring privileges may be revoked in the event of my failure to follow all WSC rules and regulations and directions.
6. I have read the WSC Member Manual.
7. I understand that participating in certain WSC sponsored events – such as racing and operating WSC equipment – requires the skipper in charge of the vessel to be a member of the WSC; and I will see that this is so in such circumstances.
8 By signing the Mooring Application I automatically become eligible to be a member of WSC. Membership in WSC is primarily for insurance purposes; however, WSC members are encouraged to participate in club-sponsored events.
9. I agree on behalf of myself, my heirs, successors, assigns, guests, and invitees to release WSC, its officers, as well as their heirs, successors and assigns, from any and all causes of action, of whatever nature, which I might now or might hereafter have against them which arise out of WSC activities. I agree to hold harmless and to indemnify the WSC, its successors, assigns, its directors and officers, its employees, its volunteers, and its members from any and all liability, damages, costs, expenses, fees and judgments arising out of WSC activities, including all such liability arising out of docks, moorings, mooring placements, extreme weather, races, and use of workboats.
10. I agree to adhere to the Great River Hydro, LLC Regulation, which prohibits overnight occupancy of boats and requires that out board motors be stored in the boat while it is moored.
11. I understand the sport of sailing is an inherently dangerous sport with many risks to body and limb and life. Sailing and sailboat racing involve risk and I hereby assume all the risks inherent with said sport, and hereby hold harmless WSC from any and all liability arising out of my participation in the sport or any races sponsored by WSC.
As a Non-Mooring Member, I agree to:
1. My duties and privileges as a non-mooring (NM) Sailor are identical with those of a regular member with the following exceptions:
2. As a NM Sailor I have no Mooring Privilege at Ward’s Cove. Therefore I may not store a dinghy, canoe or other watercraft overnight at Ward’s Cove, be such craft in the water or on shore.
3, As a NM sailor I am eligible to serve in any capacity in the club, be it as an Officer or a temporary functionary or a member of the Race Committee or Safety Boat crew.
4. When serving as crew on a member’s boat or skippering my own boat, I do so at my own risk.
5. Should I be approved to moor a boat during the season, the membership fee paid will be credited toward the mooring fee.
6. I have the privilege to familiarize myself with sailboats and sailing techniques. Such familiarization must be done under the supervision of an advisor who is a member of the Windham Sailing Club (WSC). Neither the advisor nor WSC guarantees that the familiarization will give me the skills necessary to operate a sailboat in a safe manner.
